Mesothelioma Lawyer for the People

Mesothelioma Attorney

People suffering from mesothelioma almost always experienced exposure to asbestos decades prior to being diagnosed. Frequently, the exposure to asbestos occurred in the workplace. Workers such as mechanics, construction workers, electricians, plumbers, sheet metal workers and boilermakers worked with or near asbestos containing products. Asbestos was used in many products because it is strong, flexible and heat resistant. Some asbestos products are: adhesives, cement, brakes, clutches, gaskets, pipe covering, pipe insulation and cement wallboard. Weitz & Luxenberg mesothelioma lawyers have successfully fought for the rights of many retired workers with mesothelioma and assisted them and their families in supporting themselves and paying for cancer care.
A Mesothelioma Lawyer to Fight Injustice by Companies in the Asbestos Industry

Many companies that made or distributed asbestos products knew of the lethal dangers of asbestos but chose to conceal them for the sake of financial profit. It has been reported that as far back as the 1930s, asbestos manufacturers and their insurance companies knew that asbestos was killing workers. Companies in the asbestos industry could have prevented the development of an aggressive cancer like mesothelioma by warning of the dangers of asbestos or providing safety equipment to prevent exposure to asbestos. The failure to do so was unjust. Weitz & Luxenberg mesothelioma lawyers have been fighting this injustice by filing lawsuits against asbestos industry companies to hold them accountable for the deadly harm they caused.

Mesothelioma Settlements

Confidential Information

It is estimated that 90% of mesothelioma cases are settled before trial.  However, the actual amounts of mesothelioma settlement are usually confidential because companies do not want it widely known what they are willing to pay.  This can make it more difficult for you to determine who may be the best mesothelioma lawyer for your case.  If you ask various lawyers about their mesothelioma settlements you will probably be told they are very successful.  If you press for a number perhaps you may be told “millions.”  This is not very helpful because it can be difficult to verify such statements.  So how can you get reliable information on the actual results of different lawyers when mesothelioma settlements are kept confidential?

Verdicts are Public

There is a way!  While settlement numbers are not public information, verdicts normally are.  A verdict is the formal finding of fact made by a jury on matters or questions submitted to the jury by a judge.  In the context of a mesothelioma lawsuit, verdicts also encompass the award or the amount of money the jury awarded the plaintiff (the mesothelioma victim and/or their family).  Verdicts can be used as a surrogate or indicator for mesothelioma settlements.
How is this possible?  When defendants agree to specific settlement amounts, part of their analysis is based on what they would have to pay if that particular case went to trial and there was a verdict in favor of the mesothelioma victim.  In other words, defendants consider the past verdicts of your lawyers when agreeing to a settlement figure.  Bigger historic verdicts against them (by your lawyers) usually mean higher settlements for you.  And of course, lower historic verdicts by your lawyers in past cases can mean lower future settlements.
Therefore, researching the recent verdicts of different lawyers and law firms can give you a window into the law firm’s level of success and what mesothelioma settlement you may anticipate against specific defendants. ADSENSE HERE

Veterans with Mesothelioma

Many veterans with mesothelioma don’t even think about the VA and what kinds of benefits they may be entitled to. Some think that “VA Benefits” means VA Health Care, which they either already have, or don’t want. But, allow me to provide a brief explanation of the two main benefits for which you may be entitled: VA Disability Compensation and VA Pension.
These are two financial benefits that could be extremely helpful as you deal with the financial burden of fighting this mesothelioma.
Veterans with Mesothelioma

 VA Disability Compensation (VADC)

VADC is a monthly benefit paid to any veteran who is suffering from a “service-related” disability. Usually, this means you were injured in some way while in the military, and you still have lingering effects of it after leaving the service. However, disabilities can also be “service-related” if they were caused by an “event” in service.
Therefore, veterans with mesothelioma (or any asbestos illness for that matter) are eligible for VADC if the primary reason they developed mesothelioma is because of their exposure to asbestos in the military. Notice I highlighted the word primary, and I did that because this is the crux of any asbestos claim. ADSENSE HERE

Malignant mesothelioma is an uncommon medical condition that develops from the transformation of cells in the mesothelium--a protective layer of cells that shields the heart, abdomen and lungs. The majority of mesothelioma cases result from prolonged asbestos exposure. When unbroken asbestos poses a minimal threat to people; however, when disturbed, the mineral releases cancerous particles into the air. When these fibers are perpetually inhaled they congregate in the mesothelium and eventually eat-away at the protective lining. As the cancer evolves it proliferates to remote areas of the body, forming deadly tumors along the way.

Mesothelioma prognosis is extraordinarily bleak; the cancer takes the life of nearly everyone who is infected by it. The average life expectancy for a mesothelioma sufferer is 4 to 18 months after diagnosis. These grim statistics are attributed to diagnostic complications—the disease is rarely detected in its earliest stages or when it is deemed curable.
Diagnostic complications stem from mesothelioma’s slow-developing symptoms and innocuous cellular structure.  In most cases, a mesothelioma sufferer will not observe symptoms 25-50 years after their first exposure to asbestos. When symptoms are rendered discernible, the disease has already proliferated to the point where it becomes inoperable. When malignant mesothelioma advances into its latter stages, only palliative treatment options are available. These methods are administered to mitigate malignant mesothelioma’s insufferable symptoms. Palliative treatment is elective and is undertaken to bolster the mesothelioma patient’s life. The disease, if not discovered in its infancy, is incurable.

Symptoms in the early stages of mesothelioma

In its early stages, mesothelioma does not have many symptoms, whether it is in the chest (pleura) or the abdomen (peritoneum). When symptoms do develop, they are often caused by the cancer growing and pressing on a nerve or other body organ. The symptoms mentioned below can be caused by illnesses other than mesothelioma. But if you have these symptoms, see your doctor. This is particularly important if you have been exposed to asbestos in the past.

The symptoms of pleural mesothelioma
The symptoms of pleural mesothelioma are
  • Chest pain
  • Shortness of breath
  • Tiredness (fatigue)
  • Sweating and high temperatures
  • A persistent cough
  • Losing weight when not dieting
  • Loss of appetite
  • Difficulty swallowing
  • A hoarse or husky voice

What is Malignant mesothelioma?

ADSENSE HERE
Malignant mesothelioma is a cancer that starts in cells in the linings of certain parts of the body, especially in the linings of the chest or abdomen.
Cancer starts when cells start to grow out of control. Cells in nearly any part of the body can become cancer.

Malignant mesothelioma

The mesothelium

A layer of specialized cells called mesothelial cells lines the inside of the chest, the abdomen, and the space around your heart. These cells also cover the outer surface of most of your internal organs. The lining formed by these cells is called the mesothelium.
The mesothelium helps protect your organs by making a special lubricating fluid that allows organs to move against each other. For example, this fluid makes it easier for your lungs to move (expand and contract) inside the chest when you breathe. The mesothelium has different names in different parts of the body:
  • The pleura coats the lungs and the space in the chest containing the lungs.
  • The peritoneum lines the inside of the abdomen and many of the organs in the abdomen.
  • The pericardium covers the heart and creates the space that holds the heart in the chest.
  • The tunica vaginalis lines the testicles.
Mesothelial tumors can start in any of these linings. These tumors can be non-cancerous (benign) or cancerous (malignant).

Malignant mesothelioma

A cancerous tumor of the mesothelium is called a malignant mesothelioma, although this is often shortened to just mesothelioma. Mesotheliomas can start in 4 main areas in the body.
  • Pleural mesotheliomas start in the chest. About 3 out of 4 mesotheliomas are pleural mesotheliomas.
  • Peritoneal mesotheliomas begin in the abdomen. They make up most of the remaining cases.
  • Pericardial mesotheliomas start in the covering around the heart and are very rare.
  • Mesotheliomas of the tunica vaginalis are very rare tumors that start in the covering layer of the testicles.
Malignant mesotheliomas can also be classified into 3 main types based on how the cancer cells are arranged:
  • About half of mesotheliomas are epithelioid. This type tends to have a better outlook (prognosis) than the other types.
  • About 10% of mesotheliomas are sarcomatoid (fibrous).
  • Mixed (biphasic) mesotheliomas have both epithelioid and sarcomatoid areas. They make up the remaining 30% to 40% of mesotheliomas.
